These Terms and Conditions ("Terms") govern your use of the website channelislandsexecutivecharters.com and all charter services provided by Channel Islands Executive Charters LLC ("we," "us," or "our"), operating from Channel Islands Harbor, Oxnard, California. By using our website or booking a charter, you agree to these Terms. If you do not agree, please do not use our website or services.

1. Charter Reservations and Booking

All charters are subject to availability and confirmation by Channel Islands Executive Charters. Submitting an inquiry form does not guarantee a booking. A charter is confirmed only when we issue a written booking confirmation and receive the required deposit. We reserve the right to decline any booking at our sole discretion.

2. Pricing and Payment

Charter rates are quoted per experience and are not based on the number of guests (up to our maximum of six). All prices are in U.S. dollars. A non-refundable deposit is required at the time of booking to secure your date. The remaining balance is due no later than 14 days prior to your charter date, unless otherwise agreed in writing. We accept the payment methods specified at the time of booking. Gratuities for the captain and crew are not included and are at your discretion.

3. Cancellation and Rescheduling

We understand plans change. Our cancellation policy is as follows:

30+ days before charter: Deposit may be applied to a future date within 12 months, subject to availability.

14–29 days before charter: Deposit is forfeited. No refund issued.

Less than 14 days before charter: Full charter fee is due with no refund.

We reserve the right to cancel or reschedule any charter due to unsafe weather conditions, mechanical issues, or other circumstances beyond our control. In such cases, we will offer a full reschedule to an available date or a complete refund at your choice.

4. Weather and Safety

Your safety is our highest priority. The captain holds a U.S. Coast Guard Master Captain's License with over 20 years of experience and has sole authority over all decisions regarding vessel operation, route, and safety. If the captain determines that conditions are unsafe for departure or continuation, the charter may be delayed, rerouted, or cancelled. Weather-related cancellations initiated by the captain will be rescheduled or fully refunded at your option. We are not responsible for unfavorable but safe weather conditions (overcast skies, wind, swell) that may affect your enjoyment but do not pose a safety risk.

5. Guest Conduct

All guests must follow the instructions of the captain and crew at all times. The captain reserves the right to terminate a charter without refund if any guest engages in behavior that endangers the safety of any person on board, causes damage to the vessel or equipment, involves illegal activity, or substantially disrupts the experience of other guests or crew. Guests are responsible for the cost of repairing any damage to the vessel, equipment, or furnishings caused by their actions.

6. Health, Fitness, and Assumption of Risk

Boating and offshore activities involve inherent risks, including but not limited to changing sea and weather conditions, marine wildlife encounters, motion sickness, and the physical demands of being on the open ocean. By booking a charter, you acknowledge these risks and confirm that all members of your party are in suitable health to participate. You are responsible for disclosing any medical conditions, mobility limitations, or other health concerns that may affect your ability to safely participate. We reserve the right to refuse boarding to any guest we reasonably believe cannot safely participate.

7. Liability and Waiver

To the fullest extent permitted by law, Channel Islands Executive Charters LLC, its owners, captain, crew, and agents shall not be liable for any injury, illness, death, loss, or damage to personal property arising from your participation in a charter, except where caused by our gross negligence or willful misconduct. Guests may be required to sign a liability waiver prior to boarding. This limitation of liability extends to all charter activities including but not limited to cruising, fishing, snorkeling, kayaking, paddleboarding, and dining.

8. Alcohol Policy

Alcoholic beverages are served as part of many charter packages. All guests consuming alcohol must be at least 21 years of age. The captain and crew reserve the right to limit or discontinue alcohol service to any guest at their discretion. Guests are responsible for their own alcohol consumption and behavior while aboard.

9. Fishing and Wildlife

Fishing activities, including lobster trapping (seasonal, October through March), are subject to all applicable California Department of Fish and Wildlife regulations and valid fishing licenses. It is the guest's responsibility to hold a valid California fishing license where required. We can assist with obtaining licenses upon request. Wildlife viewing (whales, dolphins, sea lions) is a natural experience and sightings cannot be guaranteed.

10. Photography, Video, and Drone Content

Many of our charter packages include professional drone video and photography. By participating in a charter, you grant Channel Islands Executive Charters a non-exclusive, royalty-free license to use photographs, video, and drone footage captured during your charter for promotional purposes, including on our website, social media, and marketing materials. If you prefer not to be included in promotional content, please notify us in writing before your charter date.

11. Private Chef and Dietary Accommodations

Our onboard chef prepares meals using fresh, locally sourced ingredients and will accommodate dietary restrictions, allergies, and special requests to the best of our ability. You must communicate all dietary requirements and food allergies at the time of booking. While we take every reasonable precaution, we cannot guarantee a completely allergen-free environment aboard the vessel.

12. Intellectual Property

All content on our website, including text, images, logos, graphics, video, and design elements, is the property of Channel Islands Executive Charters LLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content from our website without our prior written consent.

13. Third-Party Services

Certain charter packages may include services provided by third parties, such as live musicians, massage therapists, or additional watercraft (e.g., the 25-ft Parker fishing boat). While we coordinate these services on your behalf, the third-party providers operate independently and are subject to their own terms and availability. We are not liable for the acts, omissions, or quality of any third-party service.

14. Indemnification

You agree to indemnify and hold harmless Channel Islands Executive Charters LLC, its owners, officers, captain, crew, and agents from any claims, losses, damages, liabilities, or expenses (including reasonable attorney's fees) arising from your breach of these Terms, your negligent or wrongful conduct, or your use of our services.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California and, where applicable, federal maritime law. Any dispute arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Ventura County, California. You consent to the personal jurisdiction of these courts.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
